Clinical Negligence Lawyer
ACS are looking for a Clinical Negligence Lawyer on behalf of our client for their Liverpool based firm of solicitors.
Duties will include, but not be limited to,
- To risk assess claims coming into the Medical Negligence Department
- To look for winners in those case & set out the ‘roadmap’ of case direction, to include, but not limited to-
- Indicate which medical speciality to instruct
- Indicate what they are to report upon eg. breach or causation or breach & causation
- Indicate succinct but clear parameters for the expert to report on & specific questions to be raised where necessary
- Specify which questions are to be put to which experts
- Specify whether full or screening reports are required
- Review and consider the sufficiently of the light pagination (LP) generated by clinical paginator colleagues & external partners
- Identifying at the earliest appropriate moment the need to prepare & send a letter of claim (LOC) & thereafter (but not limited to)
- Set out in the RA the allegations of negligence to be put forward
- Review & propose amendments to the draft LOC within 48 hours
- To identify on risk assessments (RA) the relevant date of knowledge, record this in the case plan and record the reasons why the limitation period has been set to the date.
- Ensure correct & sufficient records have been obtained & give instructing in relation to any missing documents or in relation to inadequate LP’s
- Identify potential capacity & testatory issues & any other matters that might affect the business’s risk profile
- Advise on medical & legal issues & support junior colleagues whilst not engaging in the activities to be delegated
- Maintain an ongoing review of limitation throughout the lifespan of the claim.
- To identify the correct defendants & record on the RA. Maintain an ongoing watching brief in relation to the correct identification of defendants
- Professionally & discreetly raise any training & cultural issues with the Medical Negligence Manager
- Ensure limitation dates are identified & adequately prepared for in good time
- Advise on tactics in relation on litigation, applications (including but not limited to PAD applications) & commercial settlements thereafter.
- Maintain an eye to appropriate WIP generation & the avoidance of non-progressive & hence potentially unrecoverable WIP
- Avoid by means of commercial tactical planning unrecoverable & excessive disbursements
- Management of own case load from second Risk Assessment onwards providing direction to junior colleagues & answering queries raised by junior colleagues within 24 hours
- Refer to the COLP areas of specific or general risk are identified at any time, which need to be considered or addressed.
ESSENTIAL SKILLS AND EXPERIENCE
- Experience of handling medical negligence claims
- Previous supervisory or management experience
- Good IT skills
- Excellent attention to detail
- Commercial perspective
